AN ACT TO AMEND G.S. 20-7, RELATING TO OPERATORS' AND CHAUFFEURS' LICENSES, SO AS TO MAKE A VIOLATION THEREOF PUNISHABLE WITHIN THE DISCRETION OF THE COURT.

 

The General Assembly of North Carolina do enact:

 

Section 1.  G.S. 20-7(n) is hereby rewritten to read as follows:

"(n)       Any person convicted of violating any provision of this Section shall be guilty of a misdemeanor and punished in the discretion of the court: Provided, that no person shall be convicted of operating a motor vehicle without an operator's or chauffeur's license if he produces in court at the time of his trial upon such charge an expired operator's or chauffeur's license and a renewal operator's or chauffeur's license issued to him within thirty (30) days of the expiration date of the expired license and which would have been a defense to the charge had it been issued prior to the time of the alleged offense."

Sec. 2.  All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 3.  This Act shall be in full force and effect from and after its ratification.
