AN ACT TO CLARIFY CHAPTER 679 OF THE SESSION LAWS OF 1965 RELATING TO PROCEDURES FOR CONTRACTS AND SALES IN CONDEMNATION PROCEDURES.

 

The General Assembly of North Carolina do enact:

 

Section 1.  That subsection (d) of Section 3 of Chapter 679 of the Session Laws of 1965 as ratified on May 25, 1965, be and the same is amended by adding at the end thereof a new paragraph as follows:

"Subsections (a), (b), (c), (d) shall not be applicable in a suit against a corporation possessing the power of eminent domain under Chapter 40 of the General Statutes in which such corporation, by its answer, raises the issue of the right of the commission to condemn the land or interest therein of such corporation."

Sec. 2.  All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 3.  This Act shall be in full force and effect retroactively to May 25, 1965.
