AN ACT TO AMEND CHAPTER 156 OF THE GENERAL STATUTES SO AS TO INCREASE THE NUMBER OF DRAINAGE COMMISSIONERS FOR PITT COUNTY DRAINAGE DISTRICT NO. 1.

 

The General Assembly of North Carolina do enact:

 

Section 1. G. S. 156-81 is hereby amended by adding at the end thereof the following:

"Upon the enlargement of Pitt County Drainage District No. 1 so as to include as much as 75,000 acres of land within the District, the Clerk of the Superior Court of Pitt County, North Carolina, is authorized and directed to appoint an entire new Board of Commissioners for the Drainage District as follows: One commissioner for each 12,000 acres of land within the District, but not to exceed seven commissioners, and the commissioners so appointed shall be representative of the entire District as nearly as practical. The commissioners so appointed shall serve staggered terms of three years each, three of whom shall be appointed for a period of three years, two for a period of two years, and the remainder for a period of one year, but all commissioners thereafter shall serve for a term of three years, or until their successor is appointed. Elections and vacancies shall be filled as provided by Chapter 156, General Statutes of North Carolina, and other statutes applicable thereto.

"The duties, authorities, annual and special meetings, and compensation of the commissioners shall be governed by Chapter 156 of the General Statutes of North Carolina and other statutes applicable to Drainage Districts in North Carolina."

Sec. 2. All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 3. This Act shall be in full force and effect upon its ratification.
