AN ACT TO AMEND CHAPTER 14, SECTION 306 OF THE GENERAL STATUTES OF NORTH CAROLINA.

 

The General Assembly of North Carolina do enact:

 

Chapter 14, Section 306 of the General Statutes is hereby amended as follows:

Section 1.  On line 11, after the word "device" delete the following: "or in the playing of which the operator or user has a chance to make varying scores or tallies upon the outcome of which wagers might be made irrespective of whether it may, apart from any element of chance or unpredictable outcome of such operation, also sell, deliver or present some merchandise, indication or weight, entertainment or other thing of value."; and insert in lieu thereof the following: "or any other machine or device designed and manufactured primarily for use in connection with gambling and which machine or device is classified by the United States as requiring a Federal Gaming Device Tax Stamp under applicable provisions of the Internal Revenue Code."

Sec. 2.  At the end of the Section as it now appears in the General Statutes, add a new sentence as follows: "This definition shall not include coin operated machines or devices designed and manufactured to be played for amusement only and the operation of which depends in part upon the skill of the player."

Sec. 3.  All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 4.  This Act shall be in full force and effect from and after its ratification.
