AN ACT TO AMEND CHAPTER 279 OF THE SESSION LAWS OF 1947 TO AUTHORIZE THE BOARD OF ELECTIONS OF ORANGE COUNTY TO CONDUCT ELECTIONS OF THE TOWN OF HILLSBOROUGH.

 

The General Assembly of North Carolina do enact:

 

Section 1. Section 2 of Chapter 279 of the Session Laws of 1947 is hereby amended by adding at the end thereof a new sentence to read as follows: "For the purposes of this Act, the term 'general election' shall be deemed to mean elections for State and county officers."

Sec. 2. Sections 5, 6, 7, and 8 of Chapter 279 of the Session Laws of 1947 are hereby rewritten to read as follows:

"Sec. 5. The Board of Elections of Orange County shall conduct all elections of the Town of Hillsborough, including regular elections for the election of town officers, bond elections, and any other authorized special elections, called or requested by the Board of Commissioners of the Town. Except as otherwise provided in this Act or as otherwise provided in general or local laws relating to bond elections or other special elections in the town, all town elections shall be conducted in accordance with the laws, rules, and regulations governing the conduct of general elections in Orange County. The Board of Commissioners of the Town of Hillsborough is hereby authorized to reimburse Orange County for the actual costs of conducting each election for the town.

"Sec. 6. The Board of Elections of Orange County shall establish and maintain, and from time to time alter as necessary, a county election precinct the boundaries of which are coterminous with the corporate limits of the Town of Hillsborough. The election precinct so established shall be the town precinct for the purposes of conducting town elections, and the registrar and judges of election appointed by the Board of Elections of Orange County for such precinct shall be the registrar and judges of election for the purposes of registering voters for, and conducting, all town elections.

"Sec. 7. The Board of Elections of Orange County shall conduct and perform the registration of voters for all elections of the town, and shall use the registration books of Orange County. All persons now or hereafter duly registered in the registration books of Orange County who live within the corporate limits of the town shall be entitled to vote in all town elections. The registrar appointed by the Board of Elections of Orange County for the election precinct lying within the corporate limits of the town shall, in the manner provided by law for general elections in the county, register in the county registration books all qualified electors of the town whose names are not registered in such registration books and who present themselves to such registrar during regular registration periods. All electors of the town who are now or hereafter registered to vote in general elections in Orange County shall be deemed duly registered to vote in all town elections.

"Sec. 8. The time or times of registration applicable to general elections in the county shall also be applicable to registration for elections of the town, and the registration books in the county election precinct lying within the corporate limits of the town shall be opened for the same period or periods of time, and closed at the same time, preceding town elections, as they are opened and closed for general elections in the county, and the same rules as to challenges shall apply to town elections as apply to general elections in the county. The notices, and the time or times thereof, applicable to general elections in the county and to registration therefor, shall also be applicable to town elections, and the Board of Elections of Orange County shall cause such notices to be given as required by law."

Sec. 3. Chapter 279 of the Session Laws of 1947 is hereby amended by inserting therein, between Sections 11 and 12, two new Sections to be designated as Sections 11A and 11B, respectively, and to read as follows:

"Sec. 11A. In the event a second election is required pursuant either to Section 10 or to Section 11 or to both, then there shall be no registration of voters between the dates of the first and second elections. Persons whose qualifications to register and vote mature after the day of the first election and by the day of the second election may register on the day of the second election and when thus registered shall be entitled to vote in the second election."

"Sec. 11B. None of the provisions of Article 3 of Chapter 160 of the General Statutes shall be applicable to the Town of Hillsborough."

Sec. 4. The existing registration and poll books of the Town of Hillsborough shall no longer be used in town elections, and shall be impounded by the town clerk.

Sec. 5. All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 6. This Act shall be effective upon its ratification.
