AN ACT TO PROHIBIT THE CREATION OF LOUD AND UNNECESSARY NOISES GENERALLY IN CHINA GROVE TOWNSHIP OF ROWAN COUNTY.

 

The General Assembly of North Carolina do enact:

 

Section 1. (a) Subject to the provisions of this Act, the creation of any unreasonably loud, disturbing and unnecessary noise of such character as would be a detriment to public health, comfort, safety, welfare and prosperity of the residents of China Grove Township of Rowan County is prohibited.

(b)       The following acts, among others, are declared to be loud, disturbing and unnecessary noises in violation of this Act, but said enumeration shall not be deemed to be exclusive, namely:

(1)       The sounding of any horn or signal device on any automobile, motorcycle, bus, or other vehicle while not in motion, except as a danger signal if another vehicle is approaching apparently out of control, or if in motion only as a danger signal; the creation by means of any such signal device of any unreasonably loud or harsh sound; and the sounding of such device for an unnecessary and unreasonable period of time.

(2)       The playing of any radio, phonograph or any musical instrument in such manner or with such volume, as to annoy or disturb the quiet, comfort, or repose of any person in any dwelling, hotel, or other type of residence.

(3)       The keeping of any animal or bird, which, by causing frequent or long continued noise, shall disturb the comfort and repose of any person in the vicinity.

(4)       The use of any automobile, motorcycle, or vehicle so out of repair, so loaded or in such manner as to create loud or unnecessary grating, grinding, rattling, or other noise.

(5)       The creation of any excessive and unreasonable noise on any street adjacent to any school, institution of learning, library, or court while the same is in session, or adjacent to any hospital, or any church during services, which unreasonably interferes with the working of such institution.

(6)       The shouting and crying of peddlers, hawkers, venders, which disturb the quiet and peace of the neighborhood.

(6a)     The raising of human voice as to sing loud, speak loud, shout or scream in a disorderly manner that disturbs the quiet and peace of the neighborhood.

(7)       The use of any drum, loud-speaker, or other instrument or device for the purpose of attracting attention by creation of noise for any performance, show, sale, display, or advertisement of merchandise, or any other commercial or noncommercial purpose, unless the permission of the Rowan County Commissioners or Chief of Police of North Kannapolis in that part of Kannapolis, or the Mayor of Landis in the City of Landis and the Mayor of China Grove in the City of China Grove has been given to use same.

Sec. 2. Any person violating the provisions of this Act shall be guilty of a misdemeanor, and upon conviction shall be fined, in the discretion of the court not to exceed twenty-five dollars ($25.00).

Sec. 3. All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 4. This Act shall be in full force and effect from and after its ratification.
