AN ACT TO AMEND ARTICLE 2 OF CHAPTER 90 OF THE GENERAL STATUTES RELATING TO THE PRACTICE OF DENTISTRY.

 

The General Assembly of North Carolina do enact:

 

Section 1.  G.S. 90-41, as the same appears in the Supplement to the 1965 Replacement Volume 2C, is amended by deleting the last three paragraphs thereof.

Sec. 2.  Article 2 of Chapter 90 of the General Statutes is amended by adding a new Section thereto immediately following G.S. 90-41, as hereinabove amended, and preceding G.S. 90-42, to be designated G.S. 90-41.1 and to read as follows:

"G.S. 90-41.1.  Opportunity for Licensee or Applicant to Have Hearing. Every licensee or applicant for a license to practice dentistry, except applicants for license by comity and applicants for reinstatement after revocation, shall be afforded notice and an opportunity to be heard before the North Carolina State Board of Dental Examiners shall have authority to take any action, the effect of which would be:

(1)        To deny permission to take an examination for licensing for which application has been duly made; or

(2)        To deny a license after examination for any cause other than failure to pass an examination; or

(3)        To withhold the renewal of a license for any cause other than failure to pay a statutory renewal fee; or

(4)        To suspend a license; or

(5)        To revoke a license,

such proceedings to be conducted in accordance with the provisions of Chapter 150 of the General Statutes of North Carolina."

Sec. 3.  All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 4.  This Act shall be in full force and effect from and after its ratification.
