AN ACT TO PROVIDE FOR THE ELECTION OF THE MONROE CITY SCHOOL BOARD OF EDUCATION.

 

The General Assembly of North Carolina do enact:

 

Section 1. The Monroe City School Board of Education shall consist of seven members who shall be elected as herein provided. The terms of office of James Huntley, J. C. Plyler, Ralph Owen and A. J. Helmes, members of the present Monroe City School Board, which expire on December 2, 1968, are hereby extended to July 1, 1969. The terms of office of Fred Parker, Bill McInnis and Jack Hernig, members of the present Monroe City School Board, which expire on December 7, 1970, are hereby extended to July 1, 1971.

Sec. 2. On the third Saturday in February, 1969, the Monroe City School Board of Education may hold and conduct an election under the rules and regulations provided by the general election laws of the State for four members of the Monroe City School Board who shall serve for terms of four years each. All persons elected as members of said Board shall serve until their successors are elected and qualified and shall be elected thereafter as their terms of office expire.

Sec. 3. The Monroe City School Board of Education may appoint all necessary election officials, establish precincts, prepare and establish registration records and do any and all things necessary for the conduct of said election which could be done and performed by a county board of elections under the general election laws as contained in Chapter 163 of the General Statutes. In lieu of conducting its own election for the members of the Monroe City School Board of Education, the said Monroe City School Board of Education may contract with and may authorize the Board of Elections of Union County to conduct said election for the members of its Board of Education and may adopt and use the election officials of the county, the county's registration books and may prepare any additional registration that may be necessary by reason of the boundaries of the Monroe City Administrative Unit. The Monroe City Board of Education is authorized to pay all necessary expenses and charges for the conduct of said election whether same is conducted by the Board of Elections of Union County or by the Monroe City Board of Education.

Sec. 4. All candidates shall file for office by 6:00 p.m. on or before the sixth Saturday before the date on which the election is to be held and each candidate shall pay a filing fee of five dollars ($5.00). Such filing shall be with the Clerk of the City of Monroe. The names of all persons filing for membership on the Monroe City School Board of Education shall be placed on a ballot without party designation and said election shall be on a nonpartisan basis.

Sec. 5. In the election held in 1969, the four persons receiving the highest number of votes shall be declared elected and no person shall be entitled to call for a second election. All persons elected at the election held in 1969 shall take office on July 1, 1969 and shall serve for terms of four years or until their successors are elected and qualified.

Sec. 6. On the third Saturday in February, 1971, there shall be held an election for three members of the Monroe City School Board of Education. Said election shall be conducted as herein provided for the election of members to said Board to be held in 1969. All persons elected at the election held in 1971 shall take office on July 1, 1971 and shall serve for terms of four years or until their successors are elected and qualified.

Sec. 7. Biennially after February, 1971, there shall be held an election for the four or three vacancies, as the case may be, occurring on said Board. All persons elected shall serve for terms of four years or until their successors are elected and qualified. The elections shall be conducted as herein provided for the election to be held in 1969. Persons so elected shall take office on July 1 of the year in which elected.

Sec. 8. Any vacancy occurring on the present Monroe City School Board of Education, or on any subsequent Board, by death, resignation, or otherwise, including removal from the City Administrative Unit, shall be filled by the remaining members of the Board and the person so chosen shall fill and serve out the unexpired term and until his successor shall be elected and qualified.

Sec. 9. The members of the Monroe City School Board shall elect one of its members as chairman who shall serve for a term of two years. The chairman shall be elected at the first meeting held in July following the election of members to the Monroe City School Board beginning with the first meeting held after July 1, 1969.

Sec. 10. All laws and clauses of laws in conflict with the provisions of this Act are hereby repealed.

Sec. 11. This Act shall be in full force and effect from and after its ratification.
