AN ACT TO PROVIDE FOR THE AUTOMATIC REVIEW ON APPEAL OF THE SUFFICIENCY OF EVIDENCE IN A CRIMINAL CASE.

 

The General Assembly of North Carolina do enact:

 

Section 1.  Article 17 of Chapter 15 of the General Statutes, as the same appears in 1965 Replacement Volume 1C is hereby amended by adding a new Section immediately following G.S. 15-173, and immediately preceding G.S. 15-174, to be numbered G.S. 15-173.1, and to read as follows:

"§ 15-173.1.  The sufficiency of the evidence of the State in a criminal case is reviewable upon appeal without regard to whether a motion has been made pursuant to G.S. 15-173 in the trial court."

Sec. 2.  All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 3.  This Act shall become effective immediately upon its ratification.
