AN ACT TO CONFER IMMUNITY ON PHYSICIANS AND PATHOLOGISTS WHO REPORT DIAGNOSES OF CANCER TO LOCAL HEALTH DIRECTORS AND THE STATE BOARD OF HEALTH.

 

The General Assembly of North Carolina do enact:

 

Section 1. Article 17 of Chapter 130 of the General Statutes is amended by adding a new Section thereto, to be designated § 130-184.2, and to read as follows:

"§ 130-184.2.  Immunity of Physicians and Pathologists Who Report Cancer. Any physician or pathologist who makes a report, pursuant to this Article, to a local health director or to the State Board of Health shall be immune from any civil or criminal liability that might otherwise be incurred or imposed for so doing, unless such person acted in bad faith or with malicious purpose."

Sec. 2.  All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 3.  This Act shall be in full force and effect from and after ratification.
