AN ACT TO INCORPORATE THE TOWN OF COMO IN HERTFORD COUNTY.

 

The General Assembly of North Carolina do enact:

 

Section 1. Incorporation and Corporate Powers. The Town of Como in Hertford County is hereby incorporated and declared to be a body politic under the name and style of "Como", and as such shall have all the rights, powers and privileges conferred upon incorporated cities and towns in North Carolina by the General Statutes of this State.

Sec. 2. Corporate Area. The corporate area of the Town of Como shall consist of all of that area within a one-mile radius of the intersection of U. S. Highway No. 258 and N. C. Road No. 1317 in Hertford County.

Sec. 3. Governing Body. The governing body of the Town of Como shall consist of a mayor and four commissioners, and Guy C. Hill is hereby appointed mayor, and Linwood Whitley, Earl Fitzwater, Joyce C. Brett, and Hugh B. Picot are hereby appointed commissioners. The mayor and members of the board of commissioners appointed herein shall take office on July 1, 1967, and shall serve until their successors are duly elected and qualified as provided for in Section 4 of this Act.

All of the powers of the Town of Como shall be vested in its governing body, and the governing body may appoint such officers and employees as may be authorized pursuant to the North Carolina General Statutes. The mayor shall have a right to vote only in case of a tie deadlocking a decision of the governing body.

Sec. 4. Municipal Elections. The regular municipal election held for the purpose of electing a mayor and members of the board of commissioners in the Town of Como shall be held on Tuesday after the first Monday in May, 1969, and biennially thereafter. All municipal elections shall be conducted in accordance with the general law of the State applicable to municipal elections. Provided, however, that any qualified elector of the Town of Como may become a candidate for the office of mayor or board of commissioners by filing a written notice of such candidacy with the mayor or other person designated by the board of commissioners not less than 10 days prior to the date of the election, and by the payment of a filing fee, the amount of which shall be fixed by the board of commissioners, not to exceed three dollars ($3.00).

Sec. 5. All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 6. This Act shall become effective upon its ratification.
