AN ACT TO AMEND GS 153-5, TO PROVIDE FOR THE ELECTION OF THE BOARD OF COUNTY COMMISSIONERS OF ROWAN COUNTY.

 

The General Assembly of North Carolina do enact:

 

Section 1. G. S. 153-5 is hereby amended by adding at the end thereof the following:

"The Board of County Commissioners in Rowan County shall consist of five members, to be nominated and elected by the voters of the entire county, and the present members of the Board of Commissioners shall continue to hold office until their successors are elected and qualified as herein provided."

Sec. 2. There shall be elected in Rowan County at the general election to be held in 1968 five members of the Board of County Commissioners. The two candidates receiving highest votes in the 1968 election shall be elected for a term of four years, and the three receiving next highest vote shall be elected for two years. In the 1970 general election there shall be elected three commissioners for a term of four years and each two years thereafter there shall be elected at the regular general election the number to replace those whose terms expire.

The members elected in 1968, and thereafter, shall take office on the first Monday of December in the year said members are elected.

In the event two or more candidates receive the same number of votes in the election, the County Board of Elections shall determine which candidates are elected for a term of four years and which candidates are elected for two-year terms.

Sec. 3. All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 4. This Act shall be in full force and effect from and after its ratification.
