AN ACT TO AMEND G.S. 153-9(57) TO AUTHORIZE COUNTIES TO ACQUIRE LAND BY CONDEMNATION IN THE MANNER DESCRIBED BY ARTICLE 9 OF CHAPTER 136 OF THE GENERAL STATUTES OF NORTH CAROLINA.

 

The General Assembly of North Carolina do enact:

 

Section 1.  G.S. 153-9(57) is hereby amended by striking out the last sentence and inserting in lieu thereof the following:

"If negotiations for the purchase of land are unsuccessful, or if the county cannot obtain a good and sufficient title thereto by purchase from the owner or owners, then the Board of County Commissioners of any county may exercise the right of eminent domain and acquire any such land by condemnation in the same manner as is provided for the State Highway Commission by Article 9 of Chapter 136 of the General Statutes, as the same may from time to time provide, provided that the Board of County Commissioners of any county snail not have the power to condemn any property already devoted to public use."

Sec. 2.  This Act shall apply to the following counties: Guilford, and amends further by changing Sections 2 and 3 to read Sections 3 and 4 respectively.

Sec. 3.  All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 4.  This Act shall be in full force and effect from and after its ratification.
