HOUSE BILL 439

 

AN ACT TO PROVIDE FOR THE NOMINATION AND ELECTION OF THE BOARD OF EDUCATION OF TRANSYLVANIA COUNTY.

 

The General Assembly of North Carolina enacts:

 

Section 1. The Board of Education of Transylvania County shall consist of five members who shall be nominated and elected in a partisan primary and election as herein provided.  The primary and election shall be held and conducted in accordance with the general laws governing primaries and elections for county officers, except as otherwise provided herein.

As the terms of the present members expire, beginning with the primary and election to be held in 1976, and every two years thereafter, members of the Board of Education shall be elected for terms of four years.

Sec. 2. Those persons elected to the Board of Education shall qualify by taking the oath of office on or before the first Monday in December after their election, and their term shall begin on such date, and they shall serve until their successor has been elected and qualified.

Sec. 3. Vacancies in the membership of the Board of Education occurring for any reason shall be filled immediately by the County Executive Committee of the political party to which the vacating member belonged. The person appointed to fill the vacancy shall serve until the next election for members of the Board of Education at which time a person shall be elected to fill the unexpired term. However, if a vacancy occurs in the last twenty-six months of a member's term, the appointment shall be for the unexpired term. If a vacancy which is to be filled only to the next election occurs after the closing of the filing period for the primary next preceding that election, and no one has filed for the seat, the County Executive Committee of each political party shall name that party's nominee for the seat, and that nominee's name shall be printed on the general election ballot.

Sec. 4. It is the intent of this act that the terms of the present members of the Board of Education shall not be reduced, but as their terms expire, their successors shall be elected for terms of four years.

Sec. 5. Chapter 743, Session Laws of 1951; Chapter 726, Session Laws of 1953; Chapter 1021, Session Laws of 1967; and Chapter 913, Session Laws of 1973, are repealed; this act shall also apply to Clay County and all local acts for Clay County in conflict with this act are hereby repealed.

Sec. 6. This act shall become effective upon ratification.
