AN ACT TO INCREASE THE AMOUNT PAYABLE IN SUITS AGAINST STATE EMPLOYEES AND TO PROVIDE THAT SUCH COVERAGE IS EXCESS OVER COMMERCIAL LIABILITY INSURANCE.

 

The General Assembly of North Carolina enacts:

 

Section 1.  G.S. 143-300.6 as the same appears in the 1974 Supplement to Volume 3C of the General Statutes is hereby amended by deleting where they appear the words and figures "twenty thousand dollars ($20,000)" and by inserting in their place the words "the limit provided in the Tort Claims Act".

Sec. 2.  G.S. 143-300.6 as the same appears in the 1974 Supplement to Volume 3C of the General Statutes is hereby amended by adding a new section (c) to read as follows:

"(c)       The coverage afforded employees and former employees under this Article shall be excess coverage over any commercial liability insurance up to the limit of the Tort Claims Act."

Sec. 3.  This act shall become effective upon ratification.
