AN ACT TO REPEAL G.S. 14-415.2 AND AMEND G.S. 14-415.1 TO PROHIBIT POSSESSION OF A HAND GUN OR PISTOL FOR FIVE YEARS FROM DATE OF CONVICTION, OR TERMINATION OF SUSPENDED SENTENCE, PROBATION, OR PAROLE, WHICHEVER IS LATER.

 

The General Assembly of North Carolina enacts:

 

Section 1.  G.S. 14-415. 1(a) is hereby rewritten to read as follows:

"(a)       It shall be unlawful for any person who has been convicted in any court of this State, of any other state of the United States, or of the United States of feloniously violating any provision of Articles 3, 4, 6, 7, 8, 10, 13, 14, 15, 17, 30, 33, 36, 36A, 52A, or 53 of Chapter 14 of the General Statutes to purchase, own, possess, or have in his custody, care, or control any hand gun or other firearm with a barrel length of less than 18 inches or an overall length of less than 26 inches within five years from the date of such conviction, or unconditional discharge from a correctional institution, or termination of a suspended sentence, probation, or parole upon such conviction, whichever is later.

Every person violating the provisions of this section shall be guilty of a felony and shall be imprisoned for not more than five years in the State's prison or shall be fined an amount not exceeding five thousand dollars ($5,000), or both."

Sec. 2.  Nothing in this act would prohibit the right of any person to have possession of a firearm within his own home or on his lawful place of business.

Sec. 3.  G.S. 14-415.2 is hereby repealed.

Sec. 4.  This act shall become effective on October 1, 1975.
