AN ACT TO REFUND THE AMOUNT OF ACCUMULATED CONTRIBUTIONS IN EXCESS OF THE CONTRIBUTIONS REQUIRED OF OTHER MEMBERS OF THE LOCAL GOVERNMENTAL EMPLOYEES' RETIREMENT SYSTEM MADE BY FIREMEN NOT COVERED UNDER THE SOCIAL SECURITY ACT WHO WERE MEMBERS OF THE LOCAL GOVERNMENTAL EMPLOYEES' RETIREMENT SYSTEM.

 

The General Assembly of North Carolina enacts:

 

Section 1.  G.S. 128-27 is amended by adding a new subsection after subsection (f) to read:

"(f1)    Notwithstanding the foregoing provisions, upon or after retirement any member who was a uniformed fireman, shall upon submission of an application, be paid the sum of accumulated contributions, with regular interest thereon, made under those provisions of G.S. 128-30(b)(1) that applied from July 1, 1965, through June 30, 1971, to the extent of the contributions required of the member that were in excess of the contributions required of other members of the Local Governmental Employees' Retirement System covered under the Social Security Act as was from time to time in effect; provided that, the return of contributions shall be payable only if the contributions did not increase the retirement allowance of the member under the provisions of this Chapter."

Sec. 2.  This act shall become effective July 1, 1984.

In the General Assembly read three times and ratified, this the 5th day of July, 1984.
