HOUSE BILL 439

AN ACT TO PROVIDE THAT AS TO THE CITY OF GASTONIA, MEMBERS OF THE CITY COUNCIL EXCUSED FROM VOTING SHALL NOT BE INCLUDED IN DETERMINING THE RESULTS OF A VOTE ON A ZONING PROTEST PETITION.

The General Assembly of North Carolina enacts:

Section 1.  The second sentence of G.S. 160A-385 is amended by adding immediately before the period the words "not excused from voting".

Sec. 2.  This act applies to the City of Gastonia only.

Sec. 3.  This act is effective upon ratification.
