SENATE BILL 300

 

AN ACT TO REVISE THE PROCEDURES FOR NONJUDICIAL PUNISHMENT AND SUMMARY COURTS-MARTIAL IN THE NORTH CAROLINA NATIONAL GUARD.

 

The General Assembly of North Carolina enacts:

 

Section 1.  G.S. 127A-50 as it appears in the 1981 Replacement Volume of the General Statutes is amended by adding at the end of the section a new sentence to read as follows:

"There shall be no right to demand trial by special court- martial."

Sec. 2.  G.S. 127A-51 as it appears in the 1981 Replacement Volume of the General Statutes is amended by striking the period at the end of the section and adding the following:

"except that there shall be no right to demand trial by special court-martial."

Sec. 3.  If any provision of this act or the application thereof to any person or circumstances is held invalid, the invalidity does not affect other provisions or applications of the act which can be given effect without the invalid provision or application, and to this end the provisions of this act are severable.

Sec. 4.  This act is effective upon ratification and applies to all military offenses committed after that date.
