SENATE BILL 145

 

AN ACT TO PROVIDE FOR THE COURT OF APPEALS TO HEAR CERTAIN APPEALS IN WHICH LIFE SENTENCES ARE IMPOSED.

 

The General Assembly of North Carolina enacts:

 

Section 1.  G.S. 7A-27(a) reads as rewritten:

"(a) From a judgement of a superior court which includes a sentence of death or imprisonment for life, unless the judgement was based on a plea of guilty or nolo contendre, appeal Appeal lies of right directly to the Supreme Court in all cases in which the defendant is convicted of murder in the first degree and the judgment of the superior court includes a sentence of death or imprisonment for life."

Sec. 2.  This act shall become effective upon ratification, and applies to all judgments containing sentences of life imprisonment entered on or after that date.

In the General Assembly read three times and ratified this the 24th day of July, 1987.
