AN ACT TO CLARIFY THAT REFUSAL TO SURRENDER PROPERTY TO A LAW ENFORCEMENT OFFICER ACTING PURSUANT TO A JUDICIAL ORDER IS A CRIMINAL OFFENSE.

 

The General Assembly of North Carolina enacts:

 

Section 1.  G.S. 14-115 reads as rewritten:

"§ 14-115. Secreting property to hinder enforcement of lien or security interest.

Any person who, with intent to prevent or hinder the enforcement of a lien or security interest after a judgment or order has been issued for possession for that personal property subject to said lien or security interest, either refuses to surrender such personal property in his possession to a law enforcement officer, or removes, or exchanges, or secretes such personal property, removing, exchanging or secreting any personal property on which a lien or security interest exists, after a judgment or order for possession for that property has been issued, with intent to prevent or hinder the enforcement of the lien or security interest, shall be guilty of a misdemeanor punishable by a fine not to exceed five hundred dollars ($500.00), imprisonment for not more than six months, or both."

Sec. 2.  This act shall become effective October 1, 1989, and shall apply to offenses occurring on or after that date.

In the General Assembly read three times and ratified this the 21st day of June, 1989.
