AN ACT TO make it UNLAWFUL for any person to falsify, or direct another to falsify, a highway construction inspection report or test report required by the DEPARTMENT of TRANSPORTATION.
The General Assembly of North Carolina enacts:
SECTION 1. G.S. 136-13.2 reads as rewritten:
"§ 136-13.2. Falsifying highway inspection reports.
(a) Any employee or
agent employed by the Department of Transportation or by an engineering or
consulting firm engaged by the Department of Transportation, person who
knowingly falsifies any inspection report or test report required by the
Department of Transportation in connection with the construction of highways,
shall be guilty of a Class H felony.
(b) Any employee,
supervisor, or officer of the Department of Transportation person
who directs a subordinate under his direct or indirect supervision to falsify
an inspection report or test report required by the Department of
Transportation in connection with the construction of highways, shall be guilty
of a Class H felony.
(c) Repealed by Session Laws 1979, c. 786, s. 2, effective May 8, 1979."
SECTION 2. This act becomes effective December 1, 2005, and applies to offenses committed on or after that date.
