AN ACT TO AMEND G.S. 108-42, RELATING TO OBTAINING, OR CONTINUING TO OBTAIN, AWARDS OF OLD AGE ASSISTANCE BY MEANS OF FRAUDULENT DEVICES, FALSE STATEMENTS AND NONDISCLOSURES OF MATERIAL FACTS.

 

The General Assembly of North Carolina do enact:

 

Section 1.  Amend G.S. 108-42 by rewriting said Section so that the same shall hereafter read as follows:

"Sec. 108-42.  Fraudulent Acts Made Misdemeanor. Whoever knowingly obtains an initial award of assistance, assistance, a continuation of assistance after such initial award, or assistance greater than that to which he is justly entitled, initially or thereafter, when such person is ineligible and not entitled to such assistance, by means of willfully making a false statement or representation knowing same to be false, or by means of failing to disclose a material fact, or by impersonation or by any fraudulent scheme, plan or device; or, whoever knowingly attempts to obtain or aids and abets any person to obtain an initial award of assistance, assistance, a continuation of assistance after such initial award, or assistance greater than that to which he is justly entitled, initially or thereafter, when such person is ineligible and not entitled to such assistance, by means of willfully making a false statement or representation knowing same to be false, or by failing to disclose a material fact or by any fraudulent scheme, plan, device, or impersonation, shall be guilty of a misdemeanor, and, upon conviction, or plea of guilty, shall be fined or imprisoned, or both, at the discretion of the Court."

Sec. 2.  All laws and clauses of laws in conflict with the provisions of this Act are hereby repealed.

Sec. 3.  This Act shall be in full force and effect from and after its ratification.
