AN ACT TO REWRITE SECTION 95-88 OF THE GENERAL STATUTES SO AS TO EXCLUDE FROM THE ENUMERATION OF PERSONS EMPLOYED IN ESTABLISHMENTS THOSE PERSONS WHO ARE ENGAGED IN EXEMPT EMPLOYMENT AS DEFINED BY THE MINIMUM WAGE ACT.

 

The General Assembly of North Carolina do enact:

 

Section 1.  G.S. 95-88, as the same appears in the 1961 Cumulative Supplement to Volume 2C of the General Statutes, is hereby amended by striking out the period after the word "time" at the end of said Section and by inserting in lieu of the period a colon and the following: "Provided, a husband, wife, son, daughter or parent of the employer shall not be enumerated in determining the number of persons employed."

Sec. 2.  All laws and clauses of laws in conflict with the provisions of this Act are hereby repealed.

Sec. 3.  This Act shall be in full force and effect from and after its ratification.
