AN ACT TO PROMOTE SAFETY ON THE HIGHWAYS OF HERTFORD COUNTY BY PROHIBITING THE DISCHARGE OF RIFLES HAVING A BORE LARGER THAN .22 CALIBER, OR ANY CENTER FIRE RIFLE ON THE RIGHT-OF-WAY OF PUBLIC ROADS IN SAID COUNTY.

 

The General Assembly of North Carolina do enact:

 

Section 1. It shall be unlawful for any person to discharge any rifle having a bore larger than .22 caliber or any center fire rifle, on or from the right-of-way of any public highway, roadway or other publicly maintained thoroughfare in Hertford or Bertie Counties, or from any vehicle. whether moving or standing, upon the right-of-way of said roads.

Sec. 2. Violation of any of the provisions of this Act shall constitute a misdemeanor, punishable by fine not to exceed fifty dollars ($50.00) or imprisonment for a period not to exceed thirty (30) days, or both, in the discretion of the court.

Sec. 3. The prohibitions of this Act shall not apply to enforcement officers on the performance of official duties, and shall not prohibit the use of shotguns. This Act shall apply to the Counties of Hertford and Bertie only.

Sec. 4. All lawful peace officers of the county and State are hereby authorized, and it shall be their duty, to aid in the enforcement of this law.

Sec. 5. All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 6. This Act shall be in full force and effect from and after its ratification.
