AN ACT TO AMEND G.S. 14-278 AND G.S. 14-279 RELATING TO INJURY OF PROPERTY OF RAILROADS.

 

The General Assembly of North Carolina do enact:

 

Section 1.  G.S. 14-278 is hereby rewritten to read as follows:

"§ 14-278.  Wilful Injury to Property of Railroads. If any person shall unlawfully and wilfully, with intent to cause injury to any person passing over the railroad or damage to the equipment traveling on such road, put or place any matter or thing upon, over or near any railroad track, or destroy, injure, tamper with, or remove the roadbed, or any part thereof, or any rail, sill or other part of the fixtures appurtenant to or constituting or supporting any portion of the track of such railroad, the person so offending shall be guilty of a felony and shall be imprisoned in the State's prison not less than four months nor more than 10 years, or fined, or both."

Sec. 2.  G.S. 14-279 is hereby rewritten to read as follows:

"§ 14-279.  Unlawful Injury to Property of Railroads. If any person shall unlawfully, but without intent to cause injury to any person or damage to equipment, commit any of the acts referred to in Section 14-278, he shall be guilty of a misdemeanor."

Sec. 3.  All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 4.  This Act shall become effective upon its ratification.
