AN ACT REWRITING G.S. 14-214 RELATING TO FALSE AND FRAUDULENT STATEMENTS TO PROCURE BENEFITS UNDER INSURANCE POLICIES SO AS TO CLEARLY DESIGNATE PROHIBITED ACTS AS CONSTITUTING A FELONY, AND TO REPEAL G.S. 14-112.1.

 

The General Assembly of North Carolina do enact:

 

Section 1.  G.S. 14-214 is hereby rewritten to read as follows:

"§ 14-214.  False Statement to Procure Benefit of Insurance Policy or Certificate. Any person who shall wilfully and knowingly present or cause to be presented a false or fraudulent claim, or any proof in support of such claim, for the payment of a loss, or other benefits, upon any contract of insurance or certificate of insurance; or prepares, makes or subscribes to a false or fraudulent account, certificate, affidavit or proof of loss, or other documents or writing, with intent that the same may be presented or used in support of such claim, shall be guilty of a felony punishable by imprisonment for not more than five years or by a fine of not more than five thousand dollars ($5,000.00), or by both such fine or imprisonment in the discretion of the court."

Sec. 2.  G.S. 14-112.1, as the same appears in the 1965 Cumulative Supplement to Volume 1B of the General Statutes of North Carolina, is hereby repealed.

Sec. 3.  All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 4.  This Act shall be effective from and after its ratification, but shall not apply to any actions or indictments now pending in Courts in the State of North Carolina.
