AN ACT TO AMEND CHAPTER 126 OF THE GENERAL STATUTES OF NORTH CAROLINA, SO AS TO REQUIRE THE STATE PERSONNEL DEPARTMENT TO ESTABLISH EMPLOYMENT CLASSIFICATIONS FOR HANDICAPPED AND BLIND PERSONS, AND TO AMEND CHAPTER 111 OF THE GENERAL STATUTES OF NORTH CAROLINA, SO AS TO REQUIRE THE BUREAU OF EMPLOYMENT OF THE NORTH CAROLINA COMMISSION FOR THE BLIND TO TRANSFER CERTAIN OF ITS ACCUMULATED FUNDS TO THE STATE TREASURER AND TO FURTHER REQUIRE THE TRANSFER OF A RETIREMENT FUND FOR EMPLOYEES OF THE BUREAU OF EMPLOYMENT OF THE NORTH CAROLINA COMMISSION FOR THE BLIND TO THE TEACHERS' AND STATE EMPLOYEES' RETIREMENT FUND.

 

The General Assembly of North Carolina do enact:

 

Section 1.  Article 1 of Chapter 111 of the General Statutes of North Carolina, is hereby amended by adding immediately after "§ 111-12.3" new Sections to be designated "§ 111-12.4, § 111-12.5 and § 111-12.6," and to read as follows:

"§ 111-12.4.  On or before September 1, 1967, any funds now held by the Bureau of Employment of the North Carolina State Commission for the Blind shall be transferred to the State Treasurer to the extent that such funds in the aggregate exceed the amount of one hundred thousand dollars ($100,000.00)."

"§ 111-12.5.  Funds now held by the Bureau of Employment of the North Carolina State Commission for the Blind, not exceeding one hundred thousand dollars ($100,000.00) shall be retained by the Bureau of Employment of the North Carolina State Commission for the Blind or its successor organization as a reserve and operating capital fund to be expended by the Bureau of Employment of the North Carolina State Commission for the Blind or its successor for its lawful purposes and objectives, under direction and approval of the North Carolina State Commission for the Blind."

"§ 111-12.6.  All funds required under this Article to be deposited with or which have been heretofore transferred to the State Treasurer by the Bureau of Employment of the North Carolina State Commission for the Blind, and all future net earnings and accumulations of said Bureau or its successor, other than the one hundred thousand dollar ($100,000.00) reserve fund herein provided for, from whatever source or sources shall be periodically, but not less frequently than annually, paid over to and retained by the State Treasurer as a separate fund or account. The funds deposited with the State Treasurer shall be invested and the income from corpus shall inure to the sole benefit of the North Carolina State Commission for the Blind. The income and corpus shall be expended for services to and for the benefit of visually handicapped persons in North Carolina upon recommendation of the North Carolina State Commission for the Blind, by and with the approval of the Governor as the Director of the Budget."

Sec. 2.  All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 3.  This Act shall be effective from and after its ratification.
