AN ACT TO AMEND CHAPTER 713 OF THE SESSION LAWS OF 1965, BEING THE CHARTER OF THE CITY OF CHARLOTTE IN MECKLENBURG COUNTY.

 

The General Assembly of North Carolina do enact:

 

Section 1. Chapter 713, Session Laws of the General Assembly of North Carolina of 1965, being the Charter of the City of Charlotte, is hereby amended as follows:

(a)       Section 7.81 is hereby amended by deleting from the second sentence the proviso beginning after the word "laws" and inserting in lieu thereof the following:

"provided, that in the exercise of its authority of eminent domain for the acquisition of property to be used for streets and highways and water and sewer facilities, the City of Charlotte is hereby authorized to use the procedure and authority prescribed in Article 9 of Chapter 136 of the General Statutes of North Carolina, as now or hereafter amended; provided, further, that whenever therein the words 'Director' or 'Director of Highways' or 'Director of the Highway Commission' appear, they shall be deemed to include the 'City Manager'; provided further that nothing herein shall be construed to enlarge the power of the City of Charlotte to condemn property already devoted to public use."

(b)       Section 9.22 is hereby amended by adding a new sentence at the end thereof as follows:

"The City Council is hereby authorized to sell, convey, transfer, or assign any or all right, title and interest in or to real property owned by the City of Charlotte to other governmental units at private sale, when in the judgment of the City, such real property is no longer needed or suitable for the purposes of the City, or when such sale is deemed to be in the public interest."

Sec. 2. All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 3. This Act shall become effective upon its ratification.
