SENATE BILL 232

AN ACT TO AUTHORIZE THE WILKES COUNTY BOARD OF EDUCATION TO CONVEY CERTAIN LANDS TO THE TOWN OF WILKESBORO.

WHEREAS, the Wilkes County Board of Education is the owner of certain property located in Wilkes County in the Town of Wilkesboro which property was given to said board of education by the Parent Teacher's Association of the Town of Wilkesboro for use as a playground at the Wilkesboro High School; and

WHEREAS, since said gift of said lands to said board of education, Wilkesboro High School has been consolidated with North Wilkesboro High School and said new consolidated High School is at a location some distance from said lands; and

WHEREAS, the Wilkes County Board of Education desires to convey said tract of land to the Town of Wilkesboro in order that said tract of land, or the proceeds therefrom, shall be used for recreational purposes only: Now, therefore,

The General Assembly of North Carolina do enact:

Section 1. The Wilkes County Board of Education is hereby authorized and empowered to sell and convey to the Town of Wilkesboro, without consideration and at private sale, that certain tract or parcel of land lying and being in Wilkes County, within the limits of the Town of Wilkesboro, and adjoining the lands of the S. J. Gennings estate, B. S. Call and others and more particularly described as follows:

"Beginning at a stone in the South line of the S. J. Gennings' Estate lot, formerly the Harrison Brown lot, and runs South 17 degrees East 9 poles and 13 links to a stone on the bank of a ditch in Call's bottom, thence South 77 degrees East along and near the bank of the ditch, 26 poles to a stone near the bank of said ditch near the bank of Cub Creek, thence North 72 degrees East 21 poles to a stake at or near the West end of the abutment of the Cub Creek bridge on the North side of the creek, thence North 20 degrees West crossing the public road, 20 poles and 11 links to a stake in the street or road, that runs down the hill on the West side of John Vicker's barn; thence South about 73 degrees West coinciding with the old Call line to the beginning, containing four and one-half acres more or less."

Sec. 2. All laws and clauses of laws in conflict with the provisions of this Act are hereby repealed.

Sec. 3. This Act shall be in full force and effect from and after its ratification.
