SENATE BILL 248

AN ACT TO RATIFY AND CONFIRM THE ORGANIZATION AND CREATION OF ROBESON COUNTY DRAINAGE DISTRICT NUMBER ONE AND MAKE IT SUBJECT TO SUBCHAPTER III, CHAPTER 156 OF THE GENERAL STATUTES OF NORTH CAROLINA.

WHEREAS, Robeson County Drainage District Number One was established by Order of the Clerk of the Superior Court of Robeson County on the 29th day of February, 1912, pursuant to the provision of what is now Subchapter III of Chapter 156 of the General Statutes of North Carolina; and

WHEREAS, the Commissioners of the said Drainage District caused a system of canals and other improvements to be constructed; and

WHEREAS, there have been no assessments levied upon the lands within the said Drainage District for many years; and

WHEREAS, the canals and other improvements constructed by the said Drainage District need to be renovated and improved: Now, therefore,

The General Assembly of North Carolina do enact:

Section 1. The organization and creation of Robeson County Drainage District Number One is hereby confirmed and ratified in all respects, and it is hereby declared to be an existing drainage district with all the power and privileges provided by Subchapter III of Chapter 156 of the General Statutes of North Carolina.

Sec. 2. That the boundaries of Robeson County Drainage District Number One are hereby confirmed and ratified as being those described in the Order of the Clerk of the Superior Court of Robeson County creating said Drainage District.

Sec. 3. That the rights of way and easements as acquired by said organizational proceeding are hereby confirmed and ratified as being owned by Robeson County Drainage District Number One.

That if the width of said rights of way and easements cannot be determined from said organizational proceedings; the said Robeson County Drainage District Number One is hereby declared to be the owner of that area of land upon which existing canals and improvements are located, extending from the outer edge of the existing spoil bank to the outer edge of the spoil bank on the opposite side of the canal. If there is not a spoil bank on the opposite side of the canal, then to a point 10 feet beyond the opposite edge of the existing canal.

Sec. 4. All laws and clauses of laws in conflict herewith are hereby repealed.

Sec. 5. This Act shall be in full force and effect from and after its ratification.
