AN ACT TO PROVIDE FOR THE NOMINATION AND ELECTION OF MEMBERS TO THE BOARD OF EDUCATION OF CLEVELAND COUNTY.

 

The General Assembly of North Carolina do enact:

 

Section 1. The Board of Education of Cleveland County shall consist of five members to be nominated and elected by the qualified voters of the entire county, for staggered terms of four years as herein provided.

Sec. 2. In the primary and general election to be held for county officers in 1968, there shall be nominated and elected five members of the Cleveland County Board of Education. In the general election of 1968, the three candidates receiving the highest number of votes shall be elected for a term of four years and the two candidates receiving the next highest number of votes shall be elected for a term of two years. In 1970 and biennially thereafter, there shall be nominated and elected members of the County Board of Education to take the place of the members whose terms next expire, and the persons so elected shall serve for terms of four years.

Sec. 3. The primary and general elections provided for herein shall be held and conducted at the same time and under the same laws and regulations pertaining to the nomination and election of county officers as provided in Chapter 163 of the General Statutes except as otherwise provided herein. If the number of candidates of a political party, filing notice of candidacy, is less or equal to the number of offices to be filled, then such candidates shall be declared the nominees for such political party and no primary election shall be held for such candidates or party, and such nominees' names shall appear on the general election ballot.

Sec. 4. Any vacancy occurring on the Board of Education of Cleveland County, for any reason, shall for the remainder of the unexpired term be filled by the county executive committee of the political party to which the member causing the vacancy belongs.

Sec. 5. The Cleveland County Board of Education shall hold its organizational meeting on the first Monday in December, 1968, and biennially thereafter, and shall elect a chairman and such other officers as it deems necessary.

Sec. 6. Members of the Board of Education elected in 1968, and thereafter, shall qualify by taking the oath of office on the first Monday in December of the year in which elected, at which time their term of office shall begin.

Sec. 7. The term of office of the present members of the Cleveland County Board of Education, all of which expire in April 1969, shall continue until the first Monday in December 1968, at which time their terms shall terminate.

Sec. 8. All laws and clauses of laws in conflict with the provisions of this Act are hereby repealed.

Sec. 9. This Act shall be in full force and effect from and after ratification.
