AN ACT TO AUTHORIZE THE BOARD OF COUNTY COMMISSIONERS OF STANLY COUNTY TO DONATE AND CONVEY A TRACT OF LAND TO AND TO APPROPRIATE FUNDS TO DEFRAY THE COSTS OF THE OPERATION OF THE STANLY COUNTY VOCATIONAL WORKSHOP, INC.

 

WHEREAS, the Stanly County Vocational Workshop, Inc. is a non-stock and nonprofit corporation created and existing under and by virtue of the laws of the State of North Carolina, as contained in Chapter 55A of the General Statutes of the State of North Carolina; and

WHEREAS, the purpose of said corporation is to provide vocational training and employment for persons who are so handicapped by reason of a physical or mental condition or from multiple disabilities that the handicapped person cannot compete in the regular job market; and

WHEREAS, said corporation now maintains and operates a sheltered workshop in Albemarle, Stanly County, North Carolina, for the training of such handicapped persons; and

WHEREAS, the County of Stanly is the owner of a 30.1 acre tract of land formerly used by said county for the maintenance and operation of a county home for the aged and infirm; and

WHEREAS, the Board of County Commissioners of said county desires authority, in its discretion, to convey to said non-stock and nonprofit corporation five acres of said tract of land for the use and purpose of operating and maintaining thereon a vocational workshop in accordance with the authority contained in its Charter and in accordance with local, State, and Federal laws relating to and governing the operation of sheltered workshops for the handicapped; and

WHEREAS, said Board of County Commissioners of said county desires authority, in its discretion, in lieu of donating and conveying to said corporation said tract of land, to appropriate the sum of three thousand dollars ($3,000.00) to defray the costs of maintaining and operating said workshop for the aforesaid purposes: Now, therefore,

 

The General Assembly of North Carolina do enact:

 

Section 1. The Board of County Commissioners of Stanly County, North Carolina, is authorized, in its discretion, to donate and convey by appropriate deed a tract of land to the Stanly County Vocational Workshop, Inc., Albemarle, North Carolina, for the purpose of maintaining and operating thereon a vocational workshop in accordance with local, State, and Federal laws to provide vocational training and employment to persons who are so handicapped by reason of physical or mental condition or from multiple disabilities that such handicapped persons cannot compete in the regular job market, the tract of land now owned by said county described as follows:

Lying and being in North Albemarle Township, Stanly County, North Carolina, and being on the North side of North Carolina Road No. 1421, and beginning at a concrete monument, an old corner of the County Home property and the northwest corner of the property of Crowell Burris, and runs thence with the Burris line South 35 degrees 50 minutes East 338 feet to a concrete monument, old corner, approximately 75 feet from the North right of way of said road; thence with the old line South 26 degrees 00 minutes West, passing a concrete monument on the North right of way line of said road, for a total distance of 625 feet to a point in the old line and in the right of way of said road, which point is 14.5 feet from the center line of said road; thence a new line North 14 degrees 50 minutes West 871 feet to an iron stake, a new corner; thence a new line South 38 degrees 40 minutes East 300 feet to a concrete monument, the point of beginning, and containing five acres, more or less, as surveyed by Ellis Huneycutt, County Surveyor, Apirl 12, 1966. The above described deed shall contain an express provision that if and when said tract of land is ceased to be used for the above described purposes, the same shall revert to Stanly County.

Sec. 2. The Board of County Commissioners of Stanly County, North Carolina, is also authorized, in its discretion, in lieu of donating and conveying the tract of land described in Section 1, to appropriate the sum of three thousand dollars ($3,000.00) to defray the costs of operating and maintaining the sheltered workshop of the Stanly County Vocational Workshop, Inc.

Sec. 3. All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 4. This Act shall be in full force and effect from and after its ratification.
