AN ACT AMENDING G. S. 113-120.1 (RELATING TO TRESPASS FOR PURPOSES OF HUNTING, ETC., WITHOUT CONSENT OF LAND OWNER) AS THE SAME APPLIES TO AVERY, MITCHELL AND WATAUGA COUNTIES.

 

The General Assembly of North Carolina do enact:

 

Section 1. G. S. 113-120.1 is amended by adding at the end thereof a paragraph as follows:

"In Avery, Mitchell and Watauga Counties the punishment for a violation of this Section during the daytime shall be by a fine of not less than fifty dollars ($50.00) nor more than one hundred dollars ($100.00) or by confinement in jail for not more than thirty days, or both fine and confinement in jail, in the discretion of the court, and the punishment for a violation of this Section in said counties committed at nighttime between the hours of sunset and sunrise shall be by a fine of not less than seventy-five dollars ($75.00) nor more than one hundred fifty dollars ($150.00) or by confinement in jail for not more than thirty days, or by both fine and confinement in jail, in the discretion of the court."

Sec. 2. This Act shall apply only to Avery, Mitchell and Watauga Counties.

Sec. 3. All laws and clauses of laws in conflict with this Act are hereby repealed.

Sec. 4. This Act shall be in full force and effect from and after its ratification.
