HOUSE BILL 1129

 

 

AN ACT TO AUTHORIZE THE TOWN OF ENFIELD TO SELL AND CONVEY CERTAIN REAL ESTATE AT PRIVATE SALE.

 

WHEREAS, the Town of Enfield heretofore purchased certain real estate to be used by it as a well field; and

WHEREAS, the wells placed on said real estate failed to produce the necessary water and the Town of Enfield was forced to abandon them and obtain its municipal water supply elsewhere; and

WHEREAS, the Town of Enfield desires to sell the said real estate for industrial development; and

WHEREAS, it is believed by the town officials that the said real estate can be sold more advantageously at private sale than at public auction: Now, therefore,

 

The General Assembly of North Carolina do enact:

 

Section 1. The Town of Enfield is hereby authorized and empowered to sell and convey at private sale for industrial development and for a consideration of not less than seven hundred and fifty dollars ($750.00) per acre the following described real estate lying and being located in Enfield Township, Halifax County, North Carolina, to wit:

Tract One. That tract or parcel of land lying and being located on the easterly side of Dennis Street Extension a short distance South of the southerly city limits of the Town of Enfield, and beginning at a stake at the easterly right of way of said Dennis Street Extension and at the corner of the property owned by Clifton Ferdie Barkley and wife, Maybelle G. Barkley; and running thence South 41 degrees East along the said Barkley line 450 feet to a stake at the westerly edge of the right of way of the Atlantic Coast Line Railroad; running thence South 48 degrees 10 minutes West along the edge of the westerly right of way of said Atlantic Coast Line Railroad 697.3 feet to a stake in or near a ditch at the corner of the property owned by Mrs. Carrie J. Hunter and Henry J. Hunter; running thence North 50 degrees 30 minutes West along the said Carrie J. and Henry J. Hunter line 453.5 feet to a stake at the easterly edge of the right of way of aforesaid Dennis Street Extension; running thence North 48 degrees East along the easterly, edge of the right of way of said Dennis Street Extension 772 feet to a stake, the point of beginning. It being a tract of land containing exactly 7.552 acres according to survey and plat prepared by C. C. Corey, Registered Licensed Surveyor, Enfield, North Carolina, on March 21, 1959.

Tract Two. That tract or parcel of land lying and being located on the westerly side of Dennis Street Extension a short distance South of the southerly city limits of the Town of Enfield, and beginning at a stake at the edge of the westerly right of way of aforesaid Dennis Street Extension and at the southeasterly corner of Lot No. 12 of the Jennie B. Hunter Estate property, which lot is now owned by Carrie J. Hunter, and running thence South 48 degrees West along the westerly right of way of said Dennis Street Extension 1300 feet to a stake at the line of the farm now owned by Carrie J. Hunter and Henry J. Hunter; running thence North 50 degrees 30 minutes West along the line of said farm 152 feet to a stake; running thence North 48 degrees East 1322.5 feet to a stake in the line of aforesaid Lot No. 12; running thence South 42 degrees East along the line of aforesaid Lot No. 12 150 feet to a stake at the westerly edge of the right of way of said Dennis Street Extension containing 4.521 acres, according to survey and plat prepared by C. C. Corey, Registered Licensed Surveyor, Enfield, North Carolina, on March 21, 1959.

Sec. 2. All laws and clauses of laws in conflict with the provisions of this Act are hereby repealed.

Sec. 3. This Act shall be in full force and effect from and after the date of its ratification.

In the General Assembly read three times and ratified, this the 9th day of June, 1967.
