AN ACT PROHIBITING THE ATTAINING OF AMBULANCE SERVICE WITHOUT THE INTENT TO PAY THEREFOR IN ALAMANCE COUNTY.

 

The General Assembly of North Carolina do enact:

 

Section 1. Any person who with intent to defraud shall obtain ambulance services without intending at the time of obtaining such services to pay, if financially able, any reasonable charges therefor shall be guilty of a misdemeanor, and shall upon conviction be fined or imprisoned in the discretion of the court. A determination by the court that the recipient of such services has wilfully failed to pay for the services rendered for a period of 90 days after request for payment, and that the recipient is financially able to do so, shall raise a presumption that the recipient at the time of obtaining the services intended to defraud the provider of the services and did not intend to pay for the services.

Sec. 2. This Act shall apply to Alamance, Anson, Caswell, Davie, Gaston, Guilford, Orange, Randolph and Surry Counties only.

Sec. 3. All laws and clauses of laws in conflict with the provisions of this Act are hereby repealed.

Sec. 4. This Act shall be in full force and effect from and after its ratification.
