AN ACT TO AMEND GENERAL STATUTES 122-61 RELATING TO DETENTION OF PERSONS ALLEGED TO BE MENTALLY ILL OR INEBRIATE AND DANGEROUS TO THEMSELVES OR OTHERS.

 

The General Assembly of North Carolina enacts:

 

Section 1.  G.S. 122-61 is hereby amended by deleting the second sentence of paragraph 1 beginning with the word "He" and ending with the word "director" and inserting in lieu thereof the following sentence:

"He shall not be detained in a nonmedical facility used for the detention of individuals charged with or convicted of penal offenses. The Department of Mental Health shall make available to the Clerk of Court such medical services and transportation necessary to effect the detention deemed necessary."

Sec. 2.  This act shall become effective July 1, 1972.
