AN ACT TO PROVIDE FOR RESPONSIVE PLEADINGS AFTER MOTIONS FOR CHANGE OF VENUE.

 

The General Assembly of North Carolina enacts:

 

Section 1.  Article 1 of Chapter 1A-1 of the General Statutes is amended by striking from Rule 12(a)(l)a. the words: "If the court denies the motion or postpones its disposition until the trial on the merits," and by adding at the end thereof the words "in ruling on the motion or postponing its disposition until the trial on the merits;" so that Rule 12(a)(l)a., as amended, will read as follows:

"a.        The responsive pleading shall be served within 20 days after notice of the court's action in ruling on the motion or postponing its disposition until the trial on the merits;".

Sec. 2.  This act shall become effective upon ratification.
