AN ACT TO AMEND ARTICLE 17 OF CHAPTER 90 OF THE GENERAL STATUTES TO PROHIBIT ANY PERSON FROM DISTRIBUTING, SELLING, EXCHANGING OR DELIVERING ANY EYEGLASS OR SUNGLASS FRAME WHICH CONTAINS ANY FORM OF HIGHLY FLAMMABLE MATERIAL.

 

The General Assembly of North Carolina do enact:

 

Section 1.  Article 17 of Chapter 90 of the General Statutes is hereby amended by inserting immediately after G.S. 90-255 a new section to be numbered G.S. 90-255.1 and to read as follows:

"§ 90-255.1.  Sale of flammable frames. — No person shall distribute, sell, exchange or deliver, or have in his possession with intent to distribute, sell, exchange or deliver any eyeglass frame or sunglass frame which contains any form of cellulose nitrate or other highly flammable materials. Any person violating the provisions of this subsection shall be guilty of a misdemeanor, and upon conviction, shall be punished by a fine of not more than five hundred dollars ($500.00), or imprisonment for not more than six months or by both such fine and imprisonment in the discretion of the court."

Sec. 2.  This act shall become effective on July 1, 1971.
