AN ACT TO AMEND G.S. 1-79 RELATING TO THE RESIDENCE OF DOMESTIC CORPORATIONS.

 

The General Assembly of North Carolina enacts:

 

Section 1.  G.S. 1-79, as the same appears in the 1974 Cumulative Supplement to Volume 1A of the General Statutes, is hereby rewritten to read as follows:

"§ 1-79.  Domestic corporations. — For the purpose of suing and being sued the residence of a domestic corporation is as follows:

(1)        Where the registered or principal office of the corporation is located, or

(2)        Where the corporation maintains a place of business.

(3)        If no registered or principal office is in existence, and no place of business is currently maintained or can reasonably be found, the term 'residence' shall include any place where the corporation is regularly engaged in carrying on business."

Sec. 2.  This act shall become effective January 1, 1976.

In the General Assembly read three times and ratified, this the 8th day of April, 1975.
