AN ACT TO EXCLUDE EMPLOYEES INJURED WHILE UNDER THE INFLUENCE OF DRUGS FROM ELIGIBILITY FOR WORKMEN'S COMPENSATION.

 

The General Assembly of North Carolina enacts:

 

Section 1.  G.S. 97-12 as the same now appears in Replacement Volume 2D of the North Carolina General Statutes is hereby amended by rewriting the first sentence of that section to read as follows:

"No compensation shall be payable if the injury or death to the employee was proximately caused by:

(a)        his intoxication, provided the intoxicant was not supplied by the employer or his agent in a supervisory capacity to the employee; or

(b)        his being under the influence of any controlled substance listed in the North Carolina Controlled Substances Act, G.S. 90-86, et. seq., where such controlled substance was not by prescription by a practitioner; or

(c)        his willful intention to injure or kill himself or another."

Sec. 2.  This act shall become effective upon ratification.
