HOUSE BILL 1281

 

AN ACT TO AMEND G.S. 161-5(a) TO PROVIDE FOR THE FILLING OF A VACANCY IN THE OFFICE OF REGISTER OF DEEDS IN CERTAIN COUNTIES.

 

The General Assembly of North Carolina enacts:

 

Section 1. G. S. 161-5(a) is amended by adding a new sentence to the end thereof, to read as follows:

"In those counties subject to this act, when a vacancy occurs from any cause in the office of register of deeds, the board of county commissioners shall fill such vacancy by appointment of a successor for the unexpired term. The successor shall be from the same political party as the register of deeds being succeeded, and shall qualify and give bond as required by law. The appointment shall be from a list of three persons recommended by the county executive committee of the same political party as the register of deeds being succeeded, and these recommendations shall be made within 30 days of the vacancy and the appointment shall be made within 30 days from the receipt of recommendations; provided, if no recommendations are made within 30 days the county commissioners may proceed to fill the vacancy."

Sec. 2. This act shall apply only to the counties of Buncombe, Cherokee, Clay, Forsyth, Graham, Haywood, Jackson, Macon, Madison, Swain and Transylvania.

Sec. 3. This act shall become effective upon ratification.
