HOUSE BILL 1233

 

 

AN ACT AUTHORIZING THE NORTH CAROLINA DEPARTMENT OF AGRICULTURE TO REGULATE THE PROCESSING AND MARKETING OF PEN-RAISED QUAIL.

 

The General Assembly of North Carolina enacts:

 

Section 1.  Notwithstanding any other provision of law, or any rule or regulation of the Wildlife Resources Commission, the North Carolina Department of Agriculture is hereby given exclusive authority to regulate the production and sale of pen-raised quail for food purposes. The Department of Agriculture shall promulgate rules and regulations for the production and sale of pen-raised quail for food purposes in such a manner as to provide for close supervision of any person, firm or corporation producing and selling pen-raised quail for food purposes.

Sec. 1.5.  G.S. 113-105.2(a), as the same appears in the 1975 Replacement to Volume 3A of the General Statutes, is hereby amended on line 3 thereof by inserting between the words "of" and "pen-raised" the word "live".

Sec. 2.  The Wildlife Resources Commission shall retain its authority to regulate the possession and transportation of live pen-raised quail.

Sec. 3.  This act shall become effective on July 1, 1977.
