AN ACT TO MAKE IT A FELONY FOR A DEPARTMENT OF TRANSPORTATION EMPLOYEE TO FALSIFY TEST OR INSPECTION REPORTS.

 

The General Assembly of North Carolina enacts:

 

Section 1.  Chapter 136 of the General Statutes is hereby amended by adding a new section to read as follows:

"§ 136-13.2.  Falsifying highway inspection reports. — (a) Any employee or agent employed by the Department of Transportation or by an engineering or consulting firm engaged by the Department of Transportation, who knowingly falsifies any inspection report or test report required by the Department of Transportation in connection with the construction of highways, shall be guilty of a felony.

(b)        Any employee, supervisor, or officer of the Department of Transportation who directs a subordinate under his direct or indirect supervision to falsify an inspection report or test report required by the Department of Transportation in connection with the construction of highways, shall be guilty of a felony.

(c)        Any person convicted of the violation of this section shall be subject to a fine of not more than ten thousand dollars ($10,000) or imprisoned not more than five years, or both."

Sec. 2.  This act is effective upon ratification.
