AN ACT TO AMEND THE CHARTER OF THE CITY OF WILMINGTON TO CLARIFY THE AUTHORITY OF CITY COUNCIL TO CONTRACT WITH NON-CITY AGENCIES.

 

The General Assembly of North Carolina enacts:

 

Section 1.  The Charter of the City of Wilmington, being Chapter 495, Session Laws of 1977, is amended by adding a new section to read:

"Sec. 13.6. Contracts with non-city agencies. In undertaking and engaging in any programs authorized by general or local law, the Wilmington City Council may enter into contracts with any governmental agency, person, association, or corporation and may appropriate funds to such agency, person, association or corporation to undertake or to carry out part or all of such programs. In the event that funds appropriated for such purposes are turned over to any agency, person, association, or corporation, other than the City for expenditure, no such expenditure shall be made without the express authorization of the City, and all such expenditures shall be accounted for by the agency or organization in accordance with G.S. 159-40."

Sec. 2.  This act is effective upon ratification.
