SENATE BILL 1286

 

AN ACT TO PROVIDE FOR SEVERANCE PAY OR DISCONTINUED SERVICE RETIREMENT FOR EMPLOYEES WHO ARE SEPARATED DUE TO A REDUCTION IN FORCE.

 

The General Assembly of North Carolina enacts:

 

Section 1.  G.S. 143-27.2 is amended in the first paragraph by deleting the first sentence and inserting in its place the following two sentences:

"When the Director of the Budget determines that the closing of a State institution or a reduction in force will accomplish economies in the State Budget, he shall pay either a discontinued service retirement allowance or severance wages to any affected State employee, provided reemployment is not available. In determining whether to pay a discontinued service retirement allowance or severance wages, the Director of the Budget shall consider the recommendation of the department head involved and any recommendation of the State Personnel Director."; and by adding a new sentence at the end of the paragraph to read:

"Severance wages shall be paid according to the policies adopted by the State Personnel Commission."

Sec. 2.  This act is effective upon ratification.
