HOUSE BILL 865

 

AN ACT TO DELETE THE REQUIREMENT THAT THE HISTORIC PROPERTIES COMMISSION AND THE CITY OR COUNTY GOVERNING BOARD HOLD JOINT PUBLIC HEARINGS.

 

The General Assembly of North Carolina enacts:

 

Section 1.  G.S. 160A-399.5(4) reads as rewritten:

"(4)      The historic properties commission and the governing board shall hold a public hearing a joint public hearing or separate public hearings on the proposed ordinance.  Reasonable notice of the time and place thereof shall be given. All meetings of the commission shall be open to the public, in accordance with the North Carolina Open Meetings Law, Chapter 143, Article 33B Article 33C."

Sec. 2.  G.S. 160A-399.5(5) reads as rewritten:

"(5)      Following the joint public hearing or separate public hearings, the governing board may adopt the ordinance as proposed, adopt the ordinance with any amendments it deems necessary, or reject the proposed ordinance."

Sec. 3.  This act shall become effective with respect to ordinances adopted on or after September 1, 1987.
